Buried inside the Communications Authority of Kenya's new licensing conditions for cyber cafés is a single clause that has nothing to do with the identity checks and cybercrime concerns driving the headlines. Operators, the notice says, may not resell bulk or high-capacity internet connectivity to third parties without the regulator's explicit approval. On its own, the clause targets a narrow practice: cyber cafés and community payphone operators splitting a single wholesale line across multiple outlets to cut costs. But the same reselling model, run at far greater scale, is what keeps home internet affordable in low-income estates across Nairobi and beyond. Whether the CA's logic in this one clause eventually extends to that larger, informal market is not yet established, and the regulator has made no statement suggesting it will. What is established is that the enforcement machinery to do so already exists, and has been used before.

<ad-spot></ad-spot>
The cyber café conditions were gazetted on August 7, 2026 (Kenya Gazette Notice Vol. CXXVIII No. 135) and take effect on September 7 after the standard 30-day notice period. Operators must now verify every customer's name and identification number, keep session logs tying each visit to a specific terminal for at least three years, issue receipts, and install filters to block illegal content. The Authority has said browsing history itself will not be retained, a concession made after an earlier December 2024 proposal, which also floated mandatory CCTV, drew public pushback. Non-compliance carries a fine of 0.2 percent of annual turnover, with a floor of KES 500,000, plus possible suspension or closure. The reselling clause sits alongside these requirements, and requires operators to source connectivity only from licensed Application Service Providers and to seek CA approval before redistributing bulk capacity to anyone outside their own premises.

The market this clause could eventually reach

The practice the cyber café rule targets has an informal name in Nairobi: sambaza internet. An operator, often with no telecoms licence at all, buys a single high-capacity connection, typically a 100 Mbps or 1 Gbps line sold at enterprise rates, and redistributes it across an apartment block or several streets using MikroTik routers and outdoor Wi-Fi radios, charging residents KES 1,000 to 2,000 a month. It is not a new phenomenon, and it has already drawn regulatory attention on a separate track. In 2019, Kenya Power gave operators stringing unlicensed cables across its power poles, then mostly satellite television resellers, 14 days to remove them. In February 2025, Nairobi County officials pulled down fibre cables mounted on poles along Argwings Kodhek Road, arguing that internet service providers had ignored wayleave fees and county approval requirements for years. Both actions targeted physical infrastructure rather than licensing status, but both establish that Kenyan authorities are willing and able to act against the informal distribution layer of the internet market when they choose to.
<ad-spot></ad-spot>

Kenya's fixed broadband sector, according to the CA's third-quarter 2025/26 sector report covering January to March 2026, had Safaricom leading with 35.4 percent market share, followed by Jamii Telecommunications' Faiba brand at 19.5 percent, Wananchi Group's Zuku at 10.4 percent, Poa Internet at 9.7 percent, Ahadi Wireless at 9.2 percent, Vilcom Network at 6.0 percent, and Mawingu Networks at 3.7 percent, with Starlink holding a growing but still small 0.9 percent. Poa Internet and Mawingu, the two operators most often cited as the affordable alternative to Safaricom Home Fibre, are both listed on the CA's own Unified Licensing Framework register as licensed Application Service Providers, current as of May 2026. That matters for how far this argument can be pushed: the licensed budget ISPs are not, on the available evidence, the operators the reselling clause is aimed at. The actual target, if the clause is ever enforced beyond cyber cafés, is the tier below them, informal operators without any ASP or Network Facilities Provider licence, who do not pay the 0.5 percent regulatory turnover levy or maintain customer records, and who can consequently undercut even Poa's rates.

Why the incentive to squeeze that tier exists

A licensed operator selling a single bulk connection to an unlicensed intermediary for redistribution earns far less than it would selling direct residential connections to each household the intermediary serves. Splitting one KES 15,000 wholesale line across twenty households at KES 1,000 each nets the reseller more than it nets the wholesale provider, and none of that value returns to the licensed operator's own retail arm. If compliance costs, whether formal ASP licensing, the turnover levy, or simply the administrative burden of seeking CA approval for redistribution, become prohibitive for informal operators, the households they currently serve would need to migrate to a licensed provider's direct retail plans, typically priced well above the informal rate.
<ad-spot></ad-spot>

Mobile networks operate on finite radio spectrum per cell tower, which is genuinely scarce. Kenya's international bandwidth capacity, by contrast, expanded to 28,130.3 Gbps by mid-2026, anchored by SEACOM's 10,500 Gbps upgrade, meaning the backbone that fixed ISPs draw on is growing rather than constrained. Any future squeeze on fixed broadband pricing would therefore be a function of licensing compliance costs and market consolidation, not physical network capacity, which is a materially different, and more directly regulatory, mechanism than the one driving mobile bundle cuts.

None of this means the CA intends to extend the cyber café reselling clause to residential estate Wi-Fi. The regulator has not said so, and the September 7 rules as written apply specifically to Public Communications Access Centres. What the clause demonstrates is that the legal tool to formalise Kenya's informal internet distribution economy already exists on the statute book, tested first in the narrowest possible setting.

Could Kenya's Cyber Café Crackdown Be a Preview of the End of Cheap Estate Wi-Fi?

Airtel Kenya cut the data allocations on all four of its Smarta bundles on August 18, 2026, without changing a single price. The flagship KES 1,500 monthly plan, which offered 90GB as recently as March, now carries 32GB, a reduction of 64 percent. The KES 1,000 plan fell from 45GB to 22GB, a cut of 51 percent. Both weekly tiers lost exactly half their data. Voice minutes and SMS allocations were cut even harder in some tiers, with on-net minutes on the KES 1,000 bundle falling from 3,000 to 700.

The only warning customers received was a text message sent four days earlier, informing them that Airtel would "review" Smarta's benefits without specifying by how much. It is the second unannounced change to Airtel's core consumer proposition in a month. On July 14, Airtel Money's cross-network transfer fees rose to match M-Pesa's charges, again with no public statement. A week later, Airtel restructured its Amazing bundle range, cutting the KES 50 daily bundle from 2GB to 1GB while quietly boosting some monthly tiers.
<ad-spot></ad-spot>

Safaricom has moved in the same direction, though less visibly. Its B-Live product, a time-based bundle sold since August 2025 at KES 20 for one hour, KES 50 for three hours and KES 150 for six hours, has become inconsistent enough that Kenyans on social media describe it simply as "20 bob for 1GB," a shorthand from the bundle's early days when the fair-use ceiling before throttling sat close to a gigabyte an hour. Officially, B-Live was never sold as a fixed data amount. Subscribers now report that the same KES 20 tier can return anywhere from roughly 250MB to closer to 1GB of usable speed before the connection slows, depending on the time of day and a usage profile Safaricom does not disclose. Some customers report specific tiers vanishing from their menu entirely, only for Safaricom's support desk to describe this as normal personalisation. On August 1, the menu briefly collapsed into a single KES 25 option tied to Safaricom's Ziidi investment product, which the company blamed on a technical hitch.

Tunukiwa, Safaricom's other dynamic offer engine accessed through *444#, follows the same pattern. It has never had a public tariff sheet: Safaricom's own documentation describes it only as personalised and liable to change daily. Subscribers who once routinely received 1GB to 1.5GB for KES 50 through Tunukiwa report that offer has narrowed to roughly 350MB to 500MB for many users. Because the terms are not published anywhere, there is no official baseline to hold the telco to, which is precisely what makes the change hard to document and easy for Safaricom to describe as normal variation rather than a cut.

A rivalry that started as a price war

The context for these changes goes back to February 2025, when Airtel launched Smarta as a direct challenge to Safaricom, pairing generous data with Airtel Money cashback. It worked. Airtel has spent the past 18 months undercutting Safaricom's per-gigabyte pricing aggressively enough to draw customers away from a network that still commands 62.8 percent of Kenya's mobile broadband market and 34.3 percent of fixed internet, according to Communications Authority of Kenya data as of June 2025. Safaricom has responded with its own quiet reversals before. In November 2025 it briefly halved its "No Expiry" data bundles, doubling the effective cost of data, before restoring the old allocations within days and blaming a technical issue.
<ad-spot></ad-spot>

This week's Airtel cuts land differently because the KES 1,500 Smarta plan is now roughly half of what Airtel offered at launch, not merely a step down from a temporary high. Airtel's own justification, if it has offered one, has not been made public. What is public is Airtel Africa's most recent quarterly results, published July 22: group revenue rose 31 percent to $1,853 million for the quarter to June 30, and operating margin expanded to 50.1 percent from 48.0 percent a year earlier. The company does not break out Kenya's performance separately, grouping it with five other markets that together grew data customers 16.8 percent to 37.8 million.

What the cuts are actually solving for

Neither telco has issued a public explanation tying these changes to a specific cost pressure, so any reading of the underlying logic remains analysis rather than confirmed telco reasoning. Three forces are commonly cited by industry observers. The first is the end of promotional-tier economics: bundles like Smarta 1500's original 90GB and B-Live's early generous throughput were priced as customer acquisition tools rather than sustainable baseline products, and Communications Authority rules do not require telcos to consult the public before adjusting a promotional tariff filing.

The second is network load. Cheap, high-volume, short-validity bundles invite tethering and heavy streaming on infrastructure that, unlike fibre, has a hard capacity ceiling per cell tower. CA's own sector statistics show average mobile broadband consumption per subscription rising from 14.6GB to 15.1GB in the quarter to March 2026, with total mobile broadband usage up 6 percent to 800 million gigabytes, a trajectory that strains radio capacity faster than telcos can expand it. The third is a push toward higher average revenue per user: breaking the appeal of 20 bob and 50 bob passes nudges subscribers toward monthly plans priced at KES 1,000 or more.
<ad-spot></ad-spot>

Safaricom's own numbers support the ARPU argument. Its mobile data revenue rose 18.2 percent to KES 44.4 billion in the six months to September, according to its half-year financial results. Its August 1 Pata More campaign, which more than doubled the KES 1,000 monthly bundle from 10.2GB to 21.5GB and lifted the KES 20 daily bundle from 150MB to 250MB, looks generous in isolation. But many of the subscribers who felt the sharpest pinch this month were Airtel customers who had migrated to Smarta specifically because its KES 1,000 tier offered 45GB against Safaricom's much smaller equivalent. Airtel's cut to 22GB narrows that gap to roughly 2 percent per gigabyte, which means Safaricom's increase functions less as new generosity and more as matching a rival that has just retreated.

One regulatory detail may explain why Airtel bothered to send a warning text at all. The Kenya Information and Communications (Consumer Protection) Regulations, 2026, gazetted earlier this year, require licensees to communicate tariff and billing changes to subscribers in advance. Airtel's four-day SMS notice, thin as it was, is consistent with that requirement. Whether four days meets the spirit of the rule is a separate question, and neither the Communications Authority nor either telco has commented publicly on these bundle changes.

Why Airtel and Safaricom Are Quietly Shrinking Kenya's Cheap Data Bundles

Kenyan mobile subscribers have spent the better part of 2026 complaining that their data bundles are vanishing faster than the numbers on the package suggest they should. Safaricom's most recent public response to the complaint, issued in June, told customers to restrict background data on apps that do not need constant internet access, update apps only on WiFi, reduce YouTube streaming quality, disable automatic media downloads on WhatsApp, and turn off autoplay on social media platforms.

The advice is technically accurate. It is also, to a large share of the subscriber base, an answer to a question nobody asked. Kenyans are not confused about why a phone consumes data in the background. They are asking why a unit of data that cost roughly the same ten years ago now needs to be rationed to survive a single day of ordinary use, at a time when the web itself has become several times heavier than it was when those prices were set.

What actually happened

The frustration has a concrete, recent trigger. In late October 2025, Safaricom quietly cut the allocations on several of its popular data bundles, most notably the "No Expiry" packages that let customers buy data at fixed prices with no time limit. Subscribers who previously received 255MB for KES 51 found themselves getting 102MB for the same price, more than halving the value of the bundle. A KES 100 top-up that used to deliver 200MB effectively became far less generous, and 500MB moved to a KES 250 price point.
<ad-spot></ad-spot>

Safaricom initially avoided commenting directly, telling customers on social media platform X that it was "aware of the issue affecting the awarding of data bundles" and that a resolution was underway. After sustained public criticism, the company confirmed to local tech publication that a technical issue, not an intentional price change, had caused the cuts, and it restored the original allocations while refunding affected customers the difference in data they had missed out on.

That episode fed directly into the broader complaint building among subscribers: that Safaricom's data economics have started to feel arbitrary and one directional. In January 2026, the telco introduced transaction caps of KES 250 on USSD and KES 500 on the mySafaricom app for non-expiry bundle purchases, again drawing criticism from users who noted the caps meant more frequent, smaller purchases. By June 2026, when a customer publicly questioned why a 2GB bundle for KES 100 had disappeared from his line, Safaricom's answer was that its offers "keep changing periodically and the process is automated," a response that did little to explain why the changes so consistently trend toward less data for the same money.

The technical case Safaricom is not wrong about, and the one it is dodging

Safaricom's underlying technical claim, that modern smartphones and modern apps consume more background data than devices did a decade ago, holds up. Automatic app updates, cloud photo backups, push notification syncing, and operating system telemetry all draw on mobile data even when a phone is sitting idle on a table. Android's Settings menu under Data Usage will show most users a nontrivial chunk of consumption attributed to apps they never opened that day.

But that framing sidesteps the harder question, which is not about background processes. It is about why the price of a gigabyte has not moved in proportion to how much more a gigabyte is now expected to carry. A standard web page a decade ago loaded perhaps 1 to 2MB of data. Modern pages built on JavaScript-heavy frameworks, high resolution imagery, and third party tracking scripts routinely load 5 to 10MB for a single page view. Social platforms that once served static, compressed images now default to autoplaying 1080p video at 60 frames per second, a format that can consume a full gigabyte in twenty to thirty minutes of continuous scrolling on TikTok, Instagram Reels, or YouTube Shorts.
<ad-spot></ad-spot>

None of that is a fault of the user's habits. It is the direction the entire internet has moved, largely because platforms compete on richer, more immersive content and assume the underlying pipes will keep up. Telecom pricing in Kenya has not kept up in the way that logic would suggest it should. When Safaricom's response to that mismatch is to suggest users throttle their own video quality and disable autoplay, it is effectively asking subscribers to behave like it is still 2016, on a network priced as though it still is.

The market structure behind the pricing

Kenya's mobile market is not short on competition on paper, but it is heavily concentrated in practice. According to the Communications Authority of Kenya's sector statistics for the third quarter of the 2025/2026 financial year, covering January to March 2026, Safaricom controlled 68.9 percent of the country's 84.1 million active mobile subscriptions, with a subscriber base of 57.9 million after adding roughly 5.5 million new lines in a single quarter. In mobile broadband specifically, Safaricom held 62.7 percent of the market, though that figure had eased from 64.3 percent the previous quarter. Airtel, its nearest rival, held 27.6 percent of overall mobile subscriptions with 23.2 million subscribers.

That dominance shows up directly in bundle pricing. A side by side comparison published by Business Daily found that Airtel offers 1GB valid for one hour at KES 15, while Safaricom's equivalent bundle, at 1.2GB for the same validity window, costs KES 20. For 24 hour bundles, KES 20 buys 200MB on Safaricom versus 300MB on Airtel. Independent bundle comparison site PesaMarket, tracking 65 packages across Safaricom, Airtel, Telkom, and Faiba as of March 2026, found Telkom's Mambo 99 bundle (7.3GB for KES 99) and Airtel's Smarta 1500 (90GB for KES 1,500) offering the lowest cost per gigabyte in the market, at roughly KES 14 and KES 17 per GB respectively. Safaricom's comparable 5G 200GB bundle at KES 10,000 works out to about KES 50 per gigabyte.
<ad-spot></ad-spot>

Despite consistently pricier bundles, Safaricom's market share has not meaningfully eroded. Its strength lies less in data pricing and more in network coverage, particularly in rural counties where competitors have limited infrastructure, and in the lock-in effect of M-Pesa, which held an 89.1 percent share of Kenya's mobile money subscriptions as of March 2026, according to the same CAK data. That combination gives Safaricom limited structural pressure to compete aggressively on data pricing, since the calculation for most subscribers weighing a switch involves far more than the cost of a gigabyte.

Data has become the business

Safaricom's own financial disclosures show why data pricing sits at the centre of its commercial strategy rather than at its periphery. In the half year to September 2025, mobile data revenue overtook voice revenue for the first time in the company's history, closing at KES 44.45 billion, up 18.2 percent from KES 37.6 billion the year before, while voice revenue grew a marginal 0.5 percent to KES 41.09 billion. For the full financial year ended March 31, 2026, Safaricom PLC reported group service revenue of KES 414.1 billion, up 11.1 percent year on year, with group net income growing 67.3 percent to KES 99.7 billion. Mobile data revenue for the year grew 14.4 percent, and the company's own reporting describes it as the largest contributor to connectivity revenue, with Data ARPU (average revenue per user) rising as customers migrate to 4G and 5G devices.

This is the commercial logic that industry watchers point to when explaining why bundle sizes have not scaled with actual consumption needs. As voice and SMS revenue flattened years ago under pressure from WhatsApp and other over the top messaging services, data became the primary growth lever telcos had left. Telcos in Kenya, as elsewhere, pay for international bandwidth capacity in wholesale terms, gigabits per second of throughput, largely denominated in US dollars, then resell that capacity to retail customers in volumetric units, megabytes and gigabytes, bundled with expiry windows. That structure allows operators to extract far more retail value from data than its incremental wholesale cost would suggest, particularly through breakage, the portion of a time-limited bundle that expires unused. Short validity bundles push subscribers into a repurchase cycle that keeps unit margins wide even when actual per-gigabyte transmission costs continue to fall industry-wide.
<ad-spot></ad-spot>

A regulatory survey referenced by Kenya Insights in January 2026 found that only 18 percent of Safaricom customers report receiving regular, detailed billing information, compared with 44.1 percent of Airtel subscribers and 35 percent of Jamii Telecommunications customers. That opacity compounds the frustration: subscribers cannot easily verify whether their data depleted because of genuinely heavier usage, background processes, or billing inconsistencies, because the operator with the largest market share also provides the least visibility into consumption.

What would actually move the needle

Kenya is not without avenues for correcting this. The Communications Authority of Kenya has statutory power to scrutinise dominant market positions and can, in principle, compel more transparent billing or investigate whether pricing structures constitute an abuse of market power, though it has not to date imposed data pricing controls on Safaricom specifically. Infrastructure competition is also shifting the picture at the margins: Starlink's satellite internet service has begun gaining traction in Kenya's fixed broadband segment, and fibre and fixed wireless providers such as Jamii Telecommunications, Wananchi Group, and Poa Internet Kenya continue to compete for household connectivity outside the mobile network.

None of these forces have yet been strong enough to compress mobile data pricing in the way falling wholesale bandwidth costs would suggest is possible. Until either regulatory intervention changes the incentives or a competitor manages to erode Safaricom's coverage and M-Pesa advantages enough to force genuine price competition on data, the gap between what a gigabyte now needs to do and what a gigabyte costs in Kenya is likely to persist, regardless of how carefully individual subscribers manage their background app settings.

Why A Gigabyte In Kenya Still Costs What It Cost A Decade Ago, Even As Apps Grew Heavier

Imagine paying for your internet the same way you pay for electricity. No more flat-rate bundles, no more "unlimited" packages that quietly throttle you after 50GB. Just a meter, ticking away, and a bill at the end of the month that reflects exactly what you used.

That is the pitch behind the Kenya Information and Communications (Amendment) Bill, 2025, sponsored by Aldai MP Marianne Kitany. On paper, it sounds like consumer protection. In practice, digital rights groups say it could hand the state one of the most detailed surveillance tools it has ever had.

The Bill was published back in March 2025, but it only had its First Reading in the National Assembly on July 1, 2026. A day later, it was committed to the Departmental Committee on Communication, Information and Innovation, which is now gathering views from ISPs, consumer groups, and civil society before compiling a report for the House. That is the stage we are at now: the point where public input can still shape, stall, or kill the Bill before it moves any further.

What the Bill Actually Proposes

At its core, the Bill amends the Kenya Information and Communications Act to redefine "telecommunication operator" so that it explicitly includes internet service providers. That single change pulls ISPs into a regulatory framework built for utilities.
<ad-spot></ad-spot>
Once that happens, every ISP licensed in Kenya, from Safaricom and Airtel to Zuku, Faiba, JTL, and even satellite providers like Starlink, would be required to operate a metered billing system that:

Assigns each customer a unique and identifiable meter number

Monitors customer usage in real time

Converts that usage into "readable details"

Generates invoices based strictly on consumption

Allows users to verify their own bills

On top of that, ISPs must submit information from these billing systems, including every subscriber's meter number, to the Communications Authority of Kenya at least once every financial year. Companies that fail to comply face fines of up to KES 5 million.

Kitany frames this as a fairness issue. Her argument is that current billing practices are opaque, that "unlimited" plans often come with hidden caps, and that a metered system would let people pay only for what they actually use, protecting their economic interests under Article 46 of the Constitution.

Why Human Rights Groups Are Alarmed

Here is where the Bill runs into serious trouble. Amnesty International Kenya has come out strongly against it, arguing that the legislation would institutionalize mass surveillance under the guise of billing reform. Victor Ndede, Amnesty International's Technology and Human Rights Manager, has been one of the most vocal critics. He points out that a unique, identifiable meter number tied to each person creates a permanent trail, and that the Bill never clarifies what exactly counts as "customer usage" or what will ultimately be shared with the Communications Authority.

The International Commission of Jurists (ICJ Kenya) has gone further, describing the Bill as a Trojan horse for mass surveillance. Demas Kiprono, an ICJ Kenya representative, has compared the meter number to opening a permanent file on every citizen, one the state can access on demand.

The core legal problem is glaring: the Bill contains no mention of Data Protection Act compliance, no retention limits, and no clarity on data security once subscriber records reach the Communications Authority. Kenya's Data Protection Act, 2019, exists precisely to govern how sensitive personal data like this should be collected, stored, and processed. A Bill that requires ISPs to hand over detailed usage records annually, without referencing that law at all, is either a serious oversight or a deliberate gap.
<ad-spot></ad-spot>
There is also a technical reality that makes the surveillance concerns harder to dismiss. Accurately metering usage, especially for zero-rated services, often requires Deep Packet Inspection, a technique that lets ISPs examine the actual content of data traffic rather than just its volume. Once that capability exists for billing purposes, nothing stops it from being repurposed for monitoring. Infrastructure built for one reason rarely stays confined to that reason.

The timing matters too. This Bill is moving through Parliament less than two years after the #RejectFinanceBill protests, which were organized largely through TikTok, X, and Instagram. Amnesty International has separately documented that the government's response to those protests included thousands of arbitrary arrests and dozens of enforced disappearances. Against that backdrop, a law that could map exactly who is online, when, and doing what, understandably makes people nervous.

The Economic Angle Nobody Is Talking About Enough

Beyond privacy, there is a real business cost here that deserves more attention than it is getting. Setting up metered billing infrastructure is expensive. For large players like Safaricom, that cost is absorbable. For Kenya's smaller regional ISPs, the ones that have been quietly expanding affordable internet access to rural and underserved areas through bundled, flat-rate offerings, this could be a serious blow.

These smaller providers have been a big part of why internet prices have dropped in Kenya over the past few years. Competition works. If the Bill forces them into expensive compliance regimes without support, we could see consolidation, higher prices, or providers simply exiting the market. That would hurt exactly the people the Bill claims to protect.

There is also a subtler point worth sitting with. Once fiber and mobile network infrastructure is built, the marginal cost of delivering an extra gigabyte to an existing customer is close to zero. So when a bill's justification hinges on "fair billing based on actual consumption," it is fair to ask whether this is really about fairness, or about squeezing more revenue out of a captive market that has grown used to flat, predictable pricing.

Where the Bill Goes From Here

The Bill still has a long road ahead. After the Departmental Committee finishes gathering stakeholder input, it will compile a report recommending whether the Bill proceeds unchanged, gets amended, or gets thrown out. If it survives that stage, it moves to a Second Reading, then to the Committee of the Whole House for line-by-line amendments, and finally to a Third Reading and presidential assent before it can become law.

That means there is still real room for this to change. Public participation at the committee stage is not just a formality. It is genuinely one of the few points where ISPs, consumer advocates, and ordinary Kenyans can push back on specific provisions before they get locked into law.

My Take

I think the reasonable answer here is that this Bill does not have to be either purely a billing reform or purely a surveillance tool. It could be both, and that is exactly the problem. A metered billing system does not inherently require handing the state a searchable archive of who used how much data and when. You can build a system that verifies fair billing without also building a state-facing dossier on every internet user in the country.
<ad-spot></ad-spot>
The fact that the current draft does not even reference the Data Protection Act is the clearest signal that privacy was not a primary design consideration here. If Kitany's intentions are genuinely about consumer fairness, the fix is straightforward: explicit Data Protection Act compliance, strict data minimization so that only what is needed for billing gets collected, clear retention limits, and independent oversight of what the Communications Authority does with the data it receives. None of that undermines the billing goal. All of it protects against the surveillance risk.

Until those safeguards are written into the Bill itself, rather than promised informally, it is reasonable for Kenyans to treat this as a surveillance risk wearing a billing-reform costume. The public participation window is open right now. If you run an ISP, work in tech policy, or simply care about what happens to your data once you're online, this is the moment to make your voice heard before the Bill moves any further.

Kenya's New Internet Metering Bill: Fair Billing or a Backdoor to Surveillance?

If you have ever sat through a full day of dead Wi-Fi with no explanation and no refund, the government just handed you some leverage. On July 1, 2026, the Kenya Information and Communications (Consumer Protection) Regulations, 2026 officially came into force, replacing the 2010 rules that have governed telecom consumer rights for the past 16 years.

This is not a minor update. It is part of a much larger overhaul of 15 sets of regulations under the Kenya Information and Communications Act (KICA), covering everything from phone charging ports to satellite internet licensing. But for the average Kenyan consumer, the Consumer Protection Regulations are the ones that actually change how your relationship with Safaricom, Airtel, Telkom, or your local ISP works day to day.

Here is everything you need to know, plus why a separate and far more controversial bill in Parliament could undo a lot of the goodwill these new rules are meant to create.

The Outage Credit System: Getting Paid for Bad Service

The headline change is what has been dubbed the "Outage Credit" system. If your internet or phone service goes down and the fault lies with your provider, you are now entitled to compensation, either automatically or upon request.

The important detail that many early reports glossed over is that this is not a vague, goodwill gesture left to each company's discretion. Licensees must submit their outage credit system to the Communications Authority of Kenya (CA) for approval, and once approved, it becomes a binding part of your subscriber agreement. That is a meaningful difference. It means the CA gets to review whether a provider's compensation formula is fair before it ever reaches your bill.
<ad-spot></ad-spot>
There is one exemption worth knowing about: force majeure events, think natural disasters or other circumstances outside a provider's control, are excluded from compensation. So a fibre cut caused by a landslide will not qualify, but a fibre cut caused by poor maintenance likely will.

This provision did not come out of nowhere. Earlier this year, CA Director-General David Mugonyi told a National Assembly committee that KICA 1998 "lacks clear provisions to mandate compensation for consumers during service disruptions." MPs had been pressing regulators for months over data bundles that expire before customers can use them and network outages that go uncompensated. The Outage Credit system looks like a direct response to that pressure.

No More Surprise Charges

The regulations explicitly ban telcos from charging you for premium SMS services or digital products you never opted into. If you have ever noticed a mysterious KES 20 or KES 50 deduction from your airtime for a "service" you do not remember signing up for, this is the rule meant to stop it.

Paired with this is a broader restriction on marketing communication. Companies can no longer add you to a marketing list without your prior consent, and every promotional message must clearly identify the sender and include a working opt-out option. If you have been fielding unsolicited SMS blasts for years, this gives you an actual legal basis to push back.

Free, Itemized Billing on Request

Consumers can now request a fully detailed breakdown of their data or airtime usage at no cost. The regulations go further than just granting this right. They set a minimum standard for what every bill must include:

The billing period covered

A full breakdown of charges

The applicable rates

The total amount due

The payment deadline

Providers are also required to notify you in advance of any changes to tariffs or billing structures. In other words, no more discovering a price hike only when your balance disappears faster than usual.

A Complaints Process With Actual Teeth

Previously, filing a complaint with your provider could feel like shouting into a void. The new regulations require licensees to run multi-channel customer care, covering physical locations, phone lines, and electronic channels, and to make these accessible to people with disabilities.

Complaints must now be acknowledged within 30 days, assigned a tracking reference number, and resolved free of charge. If your provider fails to resolve the issue, you can escalate directly to the CA.

Child Protection Gets Written Into Telecom Law

One provision that has received less attention but is arguably just as significant is the new child protection requirement. Licensees must now provide parental control tools and take reasonable steps to block unlawful, violent, abusive, or sexually explicit content. Providers are also explicitly barred from knowingly helping children access such content.
<ad-spot></ad-spot>
This is the first time child safety obligations have been this directly written into Kenya's telecom consumer framework, reflecting a broader global trend of regulators treating internet providers as gatekeepers rather than neutral pipes.

Emergency Access and Service Discontinuation

Two more provisions round out the package. Emergency numbers must remain free at all times, and where technically feasible, providers should be able to forward relevant personal data to emergency responders during an emergency call, a detail that will matter more in accident and crisis response scenarios.

On the other end, if a provider wants to discontinue a service entirely, they now need CA approval and must give subscribers at least three months' notice, along with a clear explanation. Customers must be allowed to exit penalty-free, with any unused balances or deposits refunded.

What Happens If Providers Ignore These Rules

Violating the regulations is now a criminal offense. Providers face fines of up to KES 1 million, up to six months in prison, or both. Licensees have a three-month compliance window from the regulations' effective date, with the CA able to grant extensions for good reason.

My take here is that the penalty structure is a genuine departure from how Kenya has historically handled telecom accountability, which has mostly relied on administrative fines that operators treat as a cost of doing business. Attaching criminal liability, even if enforcement ends up being selective, changes the calculus for compliance teams inside these companies.

The Elephant in the Room: The KICA Amendment Bill

Here is where the story gets complicated. While the Consumer Protection Regulations 2026 are being welcomed as a win for consumers, a separate and far more contentious piece of legislation is moving through Parliament that could reshape how you pay for internet entirely.

The Kenya Information and Communication (Amendment) Bill, 2025, sponsored by Aldai MP Marianne Kitany, is currently before the National Assembly's Communication, Information and Innovation Committee. Its core proposal is to force ISPs to abandon flat-rate "unlimited" home internet packages in favor of a metered billing system, similar to how water or electricity is billed.

How the Metering System Would Work

The bill amends Section 2 of KICA to expand the definition of "telecommunication operator" to explicitly include ISPs, which would require them to be licensed under the new framework (though existing licenses remain valid until they expire). It then amends Section 27A to require ISPs to operate a meter billing system that assigns every customer a unique, identifiable internet meter number, tracks real time data consumption, and generates invoices based strictly on usage.

ISPs would also be required to submit detailed billing system data, including customer meter numbers, to the CA at least once every financial year.

Kitany's argument is straightforward: she believes flat-rate billing lets ISPs profit from data that customers never actually use. "Internet service providers know that consumers will not use all data bundles they purchase leading to huge profits," she has said, framing the bill as a consumer protection measure grounded in Article 46 of the Constitution.

Why Civil Society Is Furious

Two objections keep surfacing in analysis from legal and digital rights groups, including ICJ Kenya and several Nairobi law firms that have published detailed breakdowns of the bill.

The first is surveillance. Linking every household to a traceable meter number, and requiring ISPs to report that data to the CA annually, creates exactly the kind of pipeline that privacy advocates worry about. The bill currently has no defined limits on how long this data is stored, what happens to it once the CA receives it, or what consent mechanisms apply. That is a significant gap, especially under a Data Protection Act framework that is supposed to demand exactly those kinds of safeguards.

The second objection is economic. Shifting from flat-rate to consumption-based billing would likely raise costs substantially for heavy users, including remote workers, software developers, students taking online courses, and streaming-heavy households. Critics argue this risks widening Kenya's digital divide rather than closing it, since the people most likely to get squeezed by metered billing are often the ones for whom the internet is doing the most economic and educational heavy lifting.

There is also a less-discussed provision worth noting separately: the bill introduces mandatory age verification for social media users based on national ID numbers, aimed at protecting minors online. While the intent is defensible, critics point out that a blanket ID requirement could exclude younger users and people without formal identification, cutting against the same digital inclusion goals the bill claims to support.

Two Different Philosophies Colliding

Here is the tension worth sitting with. The Consumer Protection Regulations 2026 are built around giving consumers more visibility and more compensation within the current unlimited-package model. The KICA Amendment Bill wants to replace that model entirely with a utility-style metering approach. Both are pitched as consumer protection, but they pull in fairly different directions. One assumes the flat-rate model stays and just needs better guardrails. The other assumes the flat-rate model itself is the problem.
<ad-spot></ad-spot>
Whether these two efforts end up reinforcing each other or working against each other will depend a lot on how the metering bill is amended, if it survives committee stage at all. Given how strongly civil society groups have pushed back, and the fact that similar surveillance-adjacent provisions have drawn constitutional challenges in Kenya before, it would not be surprising to see this bill significantly watered down before any final vote.

What This Means for You Right Now

The Consumer Protection Regulations 2026 are already law as of today. Practically speaking, here is what to watch for over the next three months as providers work through their compliance window:

Check whether your provider publishes an approved outage credit policy and how to claim it

Request an itemized bill if you have ever suspected hidden charges

Keep an eye out for unsolicited premium SMS subscriptions and use the new grounds to dispute them

If you are a parent, ask your ISP about the parental control tools they are now required to offer

As for the metering bill, it is still in committee, which means there is time for public participation to shape its final form. If the idea of a household internet meter number reported annually to a regulator concerns you, now is the moment to engage with the process rather than after it becomes law.

Your ISP Must Now Pay You When the Internet Goes Down: Inside Kenya's New Consumer Protection Regulations 2026

The April 30, 2026 deadline has come and gone. If you are a Starlink subscriber in Kenya and you have not yet completed your mandatory identity verification, there is a very good chance you woke up this week to no internet and an email telling you your service has been suspended. You are not alone, and the situation, while frustrating, is fixable. Here is everything you need to know about why this happened, what is going on right now, and how to get your connection back.

Why Did Starlink Require ID Verification in the First Place?

To understand the current disruptions, it helps to understand the root cause of this requirement. For most of its time in Kenya, Starlink operated in a way that was quite unusual for a telecommunications provider. You could buy a Starlink kit online, plug it in, and be online without ever showing a national ID. That era is now officially over.

The new requirement follows directives from the Communications Authority of Kenya (CA), which mandated that Starlink bring its operations in line with the country's existing telecommunications registration framework. Kenya's mobile network operators and internet service providers have long operated under strict Know Your Customer (KYC) requirements. The logic from the government's side is straightforward: if Safaricom, Airtel, Zuku, and JTL must all verify the identities of their subscribers, there is no reason a satellite internet provider should be exempt.
<ad-spot></ad-spot>
The legal foundation for this move is solid. Under the Kenya Information and Communications (Registration of Telecommunications Service Subscribers) Regulations, 2025, telecommunication operators and registration agents are required to collect original government-issued identification documents and verify them against existing government databases before a subscriber can access services. The regulations cover all users, including citizens, children, foreign nationals, refugees, and corporate entities.

Under revised regulations introduced by ICT Cabinet Secretary William Kabogo, the CA now requires every subscriber to an ICT service, not just SIM card holders, to be registered and authenticated against the National Integrated Population Registration System. (Techish) In short, the government wants to know who is behind every IP address in the country, and Starlink, after reportedly resisting similar directives elsewhere on the continent, chose to comply in Kenya rather than contest the requirement.

The stated reasons for the directive are also worth noting. The Kenyan government justified the mandate as a necessary tool to combat phone-based crimes and cyber-terrorism, bringing satellite operators under the same regulatory umbrella as mobile giants like Safaricom and Airtel. Beyond cybercrime, there is also an accountability angle: by linking subscriber accounts to verified national identities, regulators can ensure a level of traceability that was previously impossible with Starlink's model.

The Bigger Context: Why 2026 Is a Turning Point for Satellite Internet in Kenya

This verification deadline is not an isolated event. It is part of a much bigger shift in how Kenya is approaching satellite internet regulation. The CA has hiked satellite operator licence fees by up to 28 times, Amazon's Leo (formerly Project Kuiper) has just applied for its own Kenyan licence, and Safaricom's parent group has signed deals with both Starlink and Amazon to use satellite for rural backhaul.
<ad-spot></ad-spot>
The story underneath all of this is that satellite internet, once marketed and perceived as a technology that could operate outside the reach of terrestrial regulators, is being firmly pulled into the same compliance framework as every other telecoms provider in the country. For users, that means the anonymous era of satellite connectivity in Kenya is permanently closed.

It is also worth noting that Kenya has a well-established history of enforcing telecom registration deadlines. In 2022 and 2023, the Communications Authority oversaw mass SIM audits, warning that non-compliant lines would be deactivated, and they were. Millions of SIM cards were deactivated during those exercises. The April 30 Starlink deadline follows the same pattern, and enforcement has proceeded exactly as expected.

What Is Happening Right Now: Suspensions Are Real and Widespread

As of May 3, 2026, the situation on the ground is clear. Starlink has started suspending Kenyan users who failed to adhere to the mandatory registration directive for identity verification. Affected customers have started receiving suspension notices following the closure of the registration window. The suspension message being sent to affected users reads: "As required by local authorities, your Starlink service for ACC XXX-XXX has been suspended until required information has been submitted and verified."

Currently, Starlink is estimated to have around 22,000 subscribers in Kenya, all of whom were expected to comply with the directive. Not everyone managed to complete the process before the deadline, and those users are now offline. According to Starlink, the interruption is linked to regulatory compliance rather than billing issues or technical faults, and suspension of accounts will remain in place until users complete the required verification process.
<ad-spot></ad-spot>
For those affected, particularly businesses, schools, NGOs, and households in remote or rural areas that rely on Starlink as their primary or only source of internet, the disruption is significant. Starlink's customer base in Kenya includes remote businesses, schools, NGOs, and households that rely on it as primary connectivity, and for them, interruption is not a minor inconvenience.

There is, however, reassuring news: the suspension is not permanent. To restore their services, suspended Kenyan Starlink users will need to complete their verification process at any authorised retailer in Kenya. Once verified, service is restored after confirmation.

Step-by-Step: What to Do If Your Starlink Service Has Been Suspended

If you have received a suspension notice or your Starlink dish is no longer connecting, here is exactly what you need to do to get back online. It is a two-step process, and it is important to understand that completing just one step is not enough.

Step 1: Update Your Account Online First

Log into your Starlink account on the app or at starlink.com. Look for a red banner at the top of your home page. Update your name, date of birth, gender, postal address, and phone number, and upload a photo of your government-issued ID and a passport-sized photo. Make sure the name on your account matches your ID exactly, letter for letter. Mismatches are one of the fastest ways to have your verification rejected.

This online step is where many people have been getting stuck. A name on an account that does not perfectly match a national ID, even a minor spelling difference, will cause the verification to fail. Take time to double-check this before submitting.

Step 2: Visit an Authorised Retailer in Person

Take your original ID (not a copy) and a phone with the Starlink app installed to an authorised Starlink retailer in Kenya. The retailer confirms your documents in person and ties your account to a verified physical identity. You do not need to bring your dish or router.
<ad-spot></ad-spot>
You can find your nearest authorised retailer through the Starlink app or by visiting starlink.com/ke. This in-person step is not optional. Anyone advising you that completing the app update alone is sufficient is giving you incomplete information.

How Long Will Restoration Take?

Once submitted, your information will need to be verified. This process may take up to a day. If incorrect information is uploaded, there may be a further delay in the verification process. Given the predictable last-minute rush that occurred around the April 30 deadline, there may currently be queues at authorised retailers and a backlog in verifications. Patience will be required, but the process is reversible.

What Documents Do You Need?

To complete the verification, you will need:

A valid, original government-issued photo identification document, which can be your Kenyan National ID card or a valid passport. The document must not be expired or damaged. You do not need to bring your Starlink hardware. You only need your phone with the Starlink app installed and logged into your account. Ensure your phone's battery is charged before heading out.

The service providers insisted that the name entered in the "Contact Information" section of the account must exactly match the details on the ID provided. This is the single most common reason verifications are delayed or rejected, so treat it as the most important detail in the entire process.

What About Privacy and Surveillance Concerns?

Not everyone has accepted this development quietly. Digital rights groups have raised concerns about state surveillance, particularly given Kenya's history of internet restrictions during periods of political tension. The government's position is that this is about cybercrime prevention and bringing all ICT services under a single, accountable regime.

These concerns are legitimate and deserve honest acknowledgment. One of Starlink's original selling points in markets like Kenya was precisely that it operated outside the traditional terrestrial infrastructure, offering a layer of connectivity resilience. Tying Starlink accounts to verified physical identities within the country may make regulatory enforcement, including targeted suspensions, easier if required under law.
<ad-spot></ad-spot>
There is also a surveillance dimension that is worth thinking about carefully. Under revised regulations introduced by ICT Cabinet Secretary William Kabogo, the CA now requires every subscriber to an ICT service to be registered and authenticated against the National Integrated Population Registration System. This means your internet subscription is now linked to the same national identity database used across government services. Reasonable people can disagree on whether that balance between security and privacy is the right one. But the regulatory reality is what it is, and the practical choice currently facing every Kenyan Starlink user is binary: verify, or remain offline.

A Note for Rural and Underserved Users

The impact of this deadline is felt most sharply by users outside major urban centres. Starlink became popular in Kenya precisely because it reaches areas where fibre and mobile broadband are unreliable or nonexistent. For a school in Turkana or a farming business in Laikipia, Starlink is not a backup connection; it is the only connection.

For these users, the in-person verification requirement creates an additional burden. Visiting an authorised retailer may require traveling to the nearest town, which takes time and money. If you are in this situation, it is worth calling ahead to your nearest retailer to confirm hours and availability before making the trip, and to ask whether there are any mobile verification agents operating in your region.

Looking Ahead: What This Means for Starlink in Kenya Going Forward

The enforcement of this deadline signals a permanent shift in Starlink's operational status in Kenya. The satellite provider is no longer a loosely regulated, globally managed service operating at the edges of domestic telecoms policy. It is now a fully domestically regulated provider, subject to the same oversight framework as Safaricom and Airtel.

Whether that is a good or bad thing depends on your perspective. For regulators and law enforcement, it closes a gap that existed in Kenya's digital identity infrastructure. For privacy advocates and users who valued Starlink's independence, it is a loss of that distinction. For most everyday subscribers, the honest answer is that it will make very little practical difference to the quality or cost of service once the current suspension wave passes.
<ad-spot></ad-spot>
What it does mean, going forward, is that any future government directive affecting internet services in Kenya will apply to Starlink users in the same way it applies to everyone else. That is a significant change from the service's original character, and it is one that all subscribers should understand clearly as they renew their subscriptions.

What You Need to Know Right Now

If your Starlink service is currently suspended, it is because of the mandatory ID verification deadline that passed on April 30, 2026. The suspension is not permanent. To restore your service, first update your account details online at starlink.com or through the Starlink app, making absolutely sure your name matches your government ID exactly. Then visit an authorised Starlink retailer in person with your original ID and a phone that has the Starlink app installed. Service is restored after your verification is confirmed, which can take up to one business day.

If you have already completed both steps and are still waiting for restoration, the process may simply be in a queue due to the high volume of late completions. Continue to monitor your account for a confirmation notification.

Starlink Kenya's ID Verification Deadline Has Passed: Here's What Is Happening and What You Need to Do

Yesterday, December 19, 2025, Safaricom and Huawei officially launched a new low-cost internet program at the Mukuru Estate Phase II in Nairobi. While the "KSh 800 per month" price tag is grabbing headlines, the technical reality behind it—and the limitations—are where the real story lies for Kenyan tech enthusiasts.

The Technical Backbone: Huawei’s DQ ODN

Safaricom isn't just cutting prices; they are using a new type of infrastructure. This project utilizes Huawei’s Digital Quick Optical Distribution Network (DQ ODN).

The "Plug-and-Play" Factor: Unlike traditional fiber that requires complex "splicing" (melting glass cables together), this tech uses pre-connected components.

The Result: It’s faster to deploy and significantly cheaper to maintain. This cost-saving is what allows Safaricom to drop the price from the standard KSh 2,999 "Bronze" plan to just KSh 800.

When Can You Get It?

Current Status: Live at Mukuru Estate Phase II.

The Rollout: It is strictly tied to the Government’s Affordable Housing Program (AHP). If you live in a private apartment in Roysambu or a hostel in Madaraka, you cannot access this yet.

The "Sachet" Launch: Starting January 2026, Safaricom will introduce daily, weekly, and even hourly Wi-Fi "sachets" for these residents, moving away from the rigid monthly subscription model.

<ad-spot></ad-spot>
The Pros: Why It’s a Win

Price Leadership: At 800/- a month, Safaricom is effectively undercutting local "mwaura" Wi-Fi providers and making Starlink look like a luxury for the elite.

Fiber Stability: Unlike 4G bundles that crawl when everyone in a high-density area like Mukuru logs on at 7 PM, this is a fixed fiber line. It offers a "cleaner," more stable ping for students and remote workers.

Path to the Digital Economy: It’s designed for e-citizen services, remote learning, and small-scale online businesses (like transcription or digital marketing) that were previously too expensive to run on mobile data.

The "Gotchas": What They Didn't Put in the Headline

The Geographic Lockdown: This isn't a SIM card offer. It is fixed to the house. If you leave your apartment to go to work in CBD or run errands in Eastleigh, your 800/- internet stays at home. You’ll still need to buy expensive mobile bundles for the road.

The "Idle Time" Dilemma: Most residents in these estates are "hustlers" who leave early and come home late. If you are only home for 3-4 hours before bed, you are essentially paying for 20 hours of "dead" internet. The upcoming January 2026 hourly tokens might actually be a better deal for many.

Speed Caps: While not officially detailed, don't expect 100Mbps. This tier is likely capped at 5Mbps to 10Mbps. It’s enough for YouTube and WhatsApp, but heavy downloads or 4K streaming will be a struggle.

Device Limitation: Because it's a fixed router, you can't "carry it with you" like a MiFi or a phone hotspot. It benefits the family unit at home, but not the individual on the move.

<ad-spot></ad-spot>
Conclusion: A Step in the Right Direction

The Safaricom-Huawei partnership is a clear sign that the telco is finally feeling the heat from "sachet" Wi-Fi competitors and satellite providers. While the KSh 800 plan is currently a "walled garden" for Affordable Housing residents, it sets a precedent.

For the rest of us, the real test will be whether Safaricom scales this tech to other low-income urban areas or if it remains a "special project" for government-linked housing.
